As we sit here in 2011, the primary focus of law enforcement is the distribution and possession of controlled substances that are prescription drugs.That’s the most serious crime that’s occurring now with regards to narcotics offenses. But it can be any type of drug — cocaine, crack cocaine, heroine, ecstasy, those types of drugs — and marijuana for instance. Depending on the quantity of the drug possessed, whether or not it was a simple possession, or a possession with intent to distribute, or a sale and delivery of that controlled substance, will determine the possible penalty. Both Florida and Federal statutes define minimum mandatory penalties for certain quantities of drugs that are distributed, so the penalties can be very severe and if you mix weapons with drugs the ante goes up even higher. Drug cases are unique in that they are very fact specific. And what I mean by that is primarily the things we look for in a drug case is whether or not there are pieces of evidence that were obtained, and whether they were lawfully obtained by law enforcement so they are admissible in a trial against a client.
